Neste caso, o trabalhador ter\u00e1 direito ao aviso pr\u00e9vio, o saldo de sal\u00e1rio, a indeniza\u00e7\u00e3o das f\u00e9rias integrais (n\u00e3o gozadas e proporcionais, acrescidas do ter\u00e7o constitucional), a gratifica\u00e7\u00e3o natalina proporcional (13\u00ba sal\u00e1rio proporcional), a indeniza\u00e7\u00e3o compensat\u00f3ria de 40% dos dep\u00f3sitos do FGTS e o levantamento do saldo existente na conta vinculada do FGTS. Al\u00e9m disso, ele tamb\u00e9m recebe as guias de seguro-desemprego e a indeniza\u00e7\u00e3o adicional no valor de um sal\u00e1rio mensal, quando dispensado nos 30 dias que antecedem a data-base de sua categoria, de acordo com os termos da Lei n. 7.238\/84.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 11.85pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">J\u00e1 o trabalhador que for dispensando por justa causa, ou seja, com uma das justificativas previstas nas hip\u00f3teses legais de falta grave do art. 482 da CLT, receber\u00e1 apenas o saldo de sal\u00e1rio e a indeniza\u00e7\u00e3o das f\u00e9rias n\u00e3o gozadas, acrescidas do ter\u00e7o constitucional. Se optar por pedir demiss\u00e3o, o empregado tem o direito de receber o saldo de sal\u00e1rio, a indeniza\u00e7\u00e3o das f\u00e9rias integrais n\u00e3o gozadas e proporcionais, acrescidas do ter\u00e7o constitucional (mesmo que o empregado ainda n\u00e3o tenha completado um ano na empresa) e a gratifica\u00e7\u00e3o natalina proporcional (13\u00ba sal\u00e1rio proporcional).<\/span><\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 11.85pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">No caso de fal\u00eancia da empresa, ocorre o t\u00e9rmino dos contratos de trabalhos e o trabalhador tem os mesmos direitos que o do dispensado sem justa causa, conforme prev\u00ea o art. 449 da CLT. As reclama\u00e7\u00f5es trabalhistas, neste caso, ser\u00e3o processadas e julgadas pela Justi\u00e7a do Trabalho. \u00c9 importante observar que ap\u00f3s a decreta\u00e7\u00e3o da fal\u00eancia da empresa, esta n\u00e3o se sujeita \u00e0s penalidades por atraso no pagamento das verbas rescis\u00f3rias, previstas no art. 467 e no art. 477 da CLT.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 11.85pt;\"><b><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">Verbas Rescis\u00f3rias<\/span><\/b><\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 11.85pt;\"><span style=\"font-size: 10.5pt; font-family: Arial, sans-serif;\">Em rela\u00e7\u00e3o aos prazos para o pagamento das verbas rescis\u00f3rias, h\u00e1 uma diferen\u00e7a se o aviso pr\u00e9vio for trabalhado ou indenizado. Se for trabalhado, as verbas rescis\u00f3rias dever\u00e3o ser quitadas at\u00e9 o 1\u00ba dia \u00fatil imediato ao t\u00e9rmino do contrato. Se o aviso n\u00e3o for trabalhado, as verbas rescis\u00f3rias dever\u00e3o ser quitadas at\u00e9 o 10\u00ba dia, contado da data da notifica\u00e7\u00e3o da dispensa.
