\nEm 17 de dezembro de 2020 os procuradores TATIANA LIMA CAMPELO e ROBERTO RANGEL MARCONDES emitiram parecer favor\u00e1vel\u00a0 sobre o movimento grevista.<\/p>\n

A relatoria deu parecer favor\u00e1vel ao movimento grevista, considerando-o legal, tendo sua legitimidade fundamentada na intransig\u00eancia da Funda\u00e7\u00e3o CASA em negociar.\u00a0\u00a0Citamos, “Considerando, ainda, que a greve somente foi deflagrada ap\u00f3s meses de negocia\u00e7\u00e3o, sem que a FUNDA\u00c7\u00c3O CASA tenha demonstrado qualquer disponibilidade para atendimento dos pleitos econ\u00f4micos dos empregados. Dessa forma, entende-se que n\u00e3o h\u00e1 porque penalizar os trabalhadores com o desconto dos dias parados, ou determinar a sua compensa\u00e7\u00e3o, com impactos na sa\u00fade f\u00edsica e mental dos empregados.”<\/em> Em outra passagem da relatoria podemos ler, “Diante dos fatos ocorridos, \u00e9 ineg\u00e1vel que a categoria conta com substrato material suficiente para a deflagra\u00e7\u00e3o da greve. Pretender que os empregados se calem diante desse grave quadro e permane\u00e7am trabalhando, como se nada de errado houvesse, beira ao irreal”<\/em>.<\/p>\n

Os procuradores tamb\u00e9m esclarecem sobre a crise sanit\u00e1ria e as justas demandas da categoria, “conv\u00e9m mencionar que j\u00e1 foram instaurados diversos inqu\u00e9ritos civis em face do suscitante, que objetivam verificar o cumprimento das normas de
\nsa\u00fade e seguran\u00e7a durante a pandemia. Neste momento, o Minist\u00e9rio P\u00fablico do Trabalho junta aos autos Parecer T\u00e9cnico emitido por perito da Procuradoria Regional do Trabalho da 2\u00aa Regi\u00e3o, no qual se confirma que ainda n\u00e3o houve atendimento integral \u00e0s normas sanit\u00e1rias e que, agravada pelo afastamento dos trabalhadores do grupo de risco e dos trabalhadores em afastamento de sa\u00fade, aumenta a sobrecarga de trabalho dos empregados em atividade.”<\/p>\n

O Minist\u00e9rio P\u00fablico do Trabalho conclui “pela proced\u00eancia das reivindica\u00e7\u00f5es formuladas, com a declara\u00e7\u00e3o de n\u00e3o abusividade da greve, pagamento dos dias parados, cumprimento das demais obriga\u00e7\u00f5es trabalhistas, acrescidas de juros e corre\u00e7\u00e3o monet\u00e1ria, bem como concess\u00e3o de estabilidade de 90 dias aos empregados, nos termos do Precedente Normativo 36 desse E. Tribunal, e manuten\u00e7\u00e3o de todas as cl\u00e1usulas sociais existentes no instrumento coletivo anterior e atualiza\u00e7\u00e3o monet\u00e1ria das cl\u00e1usulas econ\u00f4micas.<\/em>”<\/p>\n

ATEN\u00c7\u00c3O CATEGORIA <\/strong><\/p>\n

J\u00e1 temos parecer favor\u00e1vel do Minist\u00e9rio P\u00fablico dizendo que a greve n\u00e3o \u00e9 abusiva e que n\u00e3o haver\u00e1 descontos dos dias parados. A greve segue com for\u00e7a, determina\u00e7\u00e3o e responsabilidade at\u00e9 segunda-feira, 21 de dezembro, quando ser\u00e1 julgado o diss\u00eddio coletivo \u00e0s 13h em reuni\u00e3o no Tribunal Regional do Trabalho 2\u00aa Regi\u00e3o.<\/p>\n

Em breve ser\u00e1 disponibilizado o link de inscri\u00e7\u00e3o para participa\u00e7\u00e3o na assembleia do sistema socioeducativo em 21 dezembro \u00e0s 20h.
